SMS & WhatsApp Terms

These SMS & WhatsApp Terms (“Messaging Terms”) govern the Presterly messaging programme (“Programme”), operated by HATCHED105 LEADERSHIP LIMITED, trading as Presterly. By opting in you agree to these Messaging Terms. They cover messages sent by SMS and over WhatsApp alike; except where a provision is expressly SMS-specific, every reference to a text message applies equally to a WhatsApp message (see section 10).
1. Programme description
The Programme sends recurring reorder reminders and occasional exclusive offers, with a link to reorder or manage your preferences. These are marketing messages; the Programme does not send informational or transactional messages, and your marketing consent is collected on its own, separate from any non-marketing consent. In the Presterly programme, you opt in directly with Presterly and every message identifies Presterly as the sender. Where a participating retail brand runs its own programme with Presterly as its service provider, your opt-in is to messages from that brand and every message identifies that brand.
2. Consent (opt-in)
You opt in to the Presterly programme in one of two ways: on our public opt-in page at presterly.com/sms-optin, by entering your mobile number and ticking an SMS-consent checkbox that is unticked by default, or by texting the keyword START (or JOIN, or SUBSCRIBE) to +1 430 203 1105, after which you receive a confirmation reply. Where a participating brand runs its own programme, you opt in with that brand, for example through an SMS consent checkbox at its checkout. By opting in, you consent to receive recurring automated marketing and promotional text messages, which may be sent using an automatic telephone dialling system or other automated technology, at the mobile number you provided. Consent is not a condition of any purchase. For recipients in the European Union, consent is collected to the standard required by the GDPR and the ePrivacy rules (in Ireland, S.I. No. 336 of 2011): freely given, specific, informed, and unambiguous, per channel.
3. Eligibility and your number
The Programme is intended for people aged 18 or over. By opting in, you confirm that you are the account holder or customary user of the mobile number you provided, and you agree to notify the brand or us at fergus@presterly.com if you change or give up that number, so it is not messaged after it stops being yours.
4. Message frequency
Message frequency varies, based on your purchase history and the reminders and campaigns run on the programme you joined.
5. Cost
Message and data rates may apply, per your mobile plan. We do not charge you for messages; your carrier’s standard rates apply.
6. Opt-out
Reply STOP to any message to cancel at any time (STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT are all honoured). We send one confirmation message, then no further messages. Opting out applies to the programme you reply to; if you have opted in to more than one programme, opt out of each, or email fergus@presterly.com and we will remove you from all Presterly-operated programmes. Opt-outs are recorded and are never overridden.

8. Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Supported carriers may change without notice. We may suspend or end the Programme, or your participation in it, at any time without notice or liability.
9. Privacy and no sharing
Your information is handled in line with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Opt-in data is not shared with third parties for their own purposes. Phone numbers captured through Programme opt-in surfaces are stored encrypted, together with a record of the consent given.
10. WhatsApp messages
Where you have opted in to receive WhatsApp marketing from a participating brand, the same reminders may be sent to you over WhatsApp instead of SMS. WhatsApp consent is separate from SMS consent: opting in to one channel does not opt you in to the other. You can stop WhatsApp messages at any time by replying STOP, using WhatsApp’s block or opt-out tools, or emailing fergus@presterly.com. WhatsApp messages are delivered over Meta’s WhatsApp Business Platform and are also subject to WhatsApp’s own terms.
11. Changes
We may update these Messaging Terms from time to time; changes are effective when posted, and we will update the “Last updated” date above. Material changes do not expand the messages you receive beyond your consent.
